Domestic violence is any incident of violence, threatening behaviour or abuse between people who are or have been in a relationship together or between family members.
It can be physical, emotional or both. Children are often also caught up in domestic violence, which can have a long-term impact.
If you suffer domestic violence, DFJ Solicitors' family law team strongly advise you to contact the police. They have powers to deal with the abuser and can put you in touch with their domestic violence specialists.
We can also advise and assist you in applying to the civil courts for either or both:
- an injunction known as a non-molestation order to protect you from being harassed, intimidated, pestered or threatened with violence and/or use of violence. Breaching such an order became a criminal offence from 1 July 2007 and this can now be punished with a fine or imprisonment or both
- an occupation order, which can prevent the abuser from returning to or attempting to enter the home. A power of arrest can be attached to this type of order, so if the abuser breaks this order they can be arrested and face possible imprisonment and/or a fine.
